Two convicted, two acquitted in Chinapen murder

THE lone female, along with a friend, are among two persons acquitted when the Brian Chinapen murder trial came to an abrupt end yesterday.
Consequently Justice Franklyn Holder directed the jury panel to return a formal verdict of not guilty in favour of Roopdai Sukhram, called Shanta and Rajendra Lall, alias Rajin, acquitting them of the capital offence.

However, their co-accused Hardat Singh, alias Vickey, son of Sukhram, and Kapaldeo Singh, called Rohan, who threw in the towel by confessing to a manslaughter charge, were found guilty.

They will know their fate on March 30, pending a probation report.
The prosecution’s main witness, Shameer Osman, had told the judge and the mixed jury that he was awakened on hearing lashing sounds, and on peering through his window he saw the accused persons beating the now deceased Brian Chinapen with sticks.
Osman said the injured man appeared lifeless when the accused persons placed him on his (Osman’s) stairway.
Chinapen was taken to Port Mourant hospital where he was pronounced dead on arrival.
A post mortem report prepared by Dr Vivikanand Brijmohan revealed that death was due to shock and haemorrhage as a result of laceration of the right kidney.
