Two farmers move to Court against Assistant Police Commissioner

– want Divisional Commander  ‘D’ Division jailed for contempt
DIVISIONAL Commander of ‘D’ Division, based at Leonora, Mr. Balram Persaud,  is to face court proceedings in order to fight two applications that request he be imprisoned for contempt of court relative to firearms Orders.
The Court is to decide on the matter on March 14, 2011.
The  applicants, Mr. Ramdyal Boodhan, of  Zeelugt, East Bank Essequibo and Mr. Shabbir Baksh of New Road, Vreed-en-Hoop, claim that the Divisional Commander had  flouted the Court’s Order  to  return to them certain licensed firearms that were wrongfully seized during 2010.
The Divisional Commander was ordered to pay the applicants costs totalling more that $40,000.
In respect of the applicant Ramdyal Boodhan, the applicant Boodhan  is asking  that:  (i) an Order that the respondent, Divisional Commander of ’D’ Division , Divisional Headquarters, Leonora, do stand committed to  prison  for contempt  for breach of an Order made by the Honourable  Chief Justice  Mr. Ian Chang on the 15th  day  of December, 2010, and further for failing to comply with the said Order which was granted  against the Respondent  in Action number 180 – M of 2010, compelling the said  Divisional Commander  to return to the applicant  one (1) Maverick  Single Barrel, 12 Gauge Shotgun, No. MV70044J, held under firearm licence  No,  G-86614,  dated the  8th  March, 2010.
In relation to the applicant  Shabbir Baksh, in his Notice of Motion asking that (i)   an  order that the respondent  Assistant  Commissioner  of  Police ‘D’ Division  Divisional Headquarters, Leonora, do stand committed  to prison  for contempt,  for breach of a Full Court Order made by the Honourable Chief Justice Mr. Ian Chang  and the Honourable Justice Rishi Persaud on the 3rd  day of December 2010,  and further for failing to comply with the said order which was granted against the respondent  in Action Mo. 62/APL of 2010, compelling the said  Assistant Commissioner  of Police to return to the applicant  one (1) .32 semi  automatic  Pistol  No, FWK27884, held under  firearm licence  No,  G6572 dated the 26th April , 2006; that the said Assistant Commissioner  of Police ‘D’ Division, Divisional Headquarters, Leonora  do pay to the applicant  costs fixed in the sum of $40,000.
The Notice of Motion was issued by Mr. Mohabir Anil Nandlall, Mr. Euclin Gomes, and Mr. Manoj  Narayan –  Attorneys-at-Law for the applicants.
