Did Abigale make a ‘dying declaration’?
JUSTICE William Ramlal, the presiding judge in the West Ruimveldt Front Road murder trial, who conducted a voir dire to determine whether Abigale Gittens, who was allegedly murdered on the front road on September 30, 2004, had made a dying declaration, will deliver his ruling on Monday.
Accused Paul Bagot, called Paul Moore, on trial for the murder of the 16 year old girl, and said to be his girlfriend, has pleaded not guilty and is being defended by lawyer Mr. Hukumchand, associated with Miss Sonia Parag.
State Prosecutor Miss Rhondel Weaver was about to tender the alleged dying declaration through Nellie Gittens, the mother of the dead girl, when defence counsel’s objection sparked off a voir dire (a trial within a trial) which was concluded yesterday.
Judge Ramlal reserved his ruling to Monday.
Evidence at the trial so far revealed that the girl, who at one time had run away from her parents’ home with the accused, is said to have had two boyfriends at the same time, while she was only 16 and a student of St. John’s College.
Justice Ramlal will deliver his ruling on the “Dying declaration” on Monday morning.
