Murder accused Small and Gopaul further remanded

MURDER accused Jarvis Small and Bibi Shareema Gopaul yesterday made their second court appearance and were further remanded to prison. Acting Chief Magistrate Priya Sewnarine-Beharry remanded the duo to prison and set November 23 for the commencement of trial.
Police Sergeant Lionel Harvey, prosecuting, informed the court that he was not in possession of the file.
Senior Counsel Mr. Bernard De Santos represented Small, who was unrepresented on his first appearance. The lawyer questioned the whereabouts of the file, but the prosecutor said he had no knowledge as to where the file is.
De Santos said he would like to know if the file is with the Director of Public Prosecutions (DPP) or somewhere else, and he hoped that the police will not change anything in the charge as it relates to where the murder occurred.
In response, the prosecutor said he is not in receipt of any knowledge as to the location of the file.
Defence Counsel Mr. Vic Puran, representing Gopaul, said at this stage the prosecution must know its case and not allow any changes whatsoever.
De Santos said if the prosecutions hops all over the place with the case, then it will be more difficult for the defence team. 
Meanwhile, Gopaul who appeared to be more relaxed than at her first appearance, was observed chatting and smiling with a fellow female inmate while sitting in court. Her mother, father, sister and aunt were also present in the court room and waited in the court yard until she was escorted out of the lock-ups.
Small, who is the number one accused, was heavily shackled with chains on his feet and handcuffed.  His wife was also present in court.
Gopaul and Small, the mother and stepfather of the slain Queen’s College student Neesa Lalita Gopaul, first appeared in court on October 8, and are accused of murdering her between September 24 and October 2, at Madewini, Soesdyke Linden Highway. They were not required to enter a plea.

The body of Neesa Lalita Gopaul was found stuffed inside a suitcase in the Madewini Creek in the vicinity of Emerald Tower Resort on Saturday, 2nd October, 2010, at about 14:00hrs and at the time she was believed to be headless.
However, a post mortem revealed that the girl was not decapitated, but her head had been clobbered beyond recognition.
Dumbbells similar to those found in a gym owned by Small were found tied to the suitcase in which the body was found.
Samples of what appeared to be blood and hair were taken from the residence of accused Bibi Gopaul and taken to the Police Forensic Department for testing.
