Toolsie Persaud Limited complains

Our Turkeyen land has been invaded by 2 defendants
IN an action filed in the Supreme Court Registry, Toolsie Persaud Limited is seeking a court order to remove defendants  David Kendall and Norma Wessels from unlawfully occupying portions of their land at Areas “F”, “G” and “H”, Turkeyen.
TPL,  represented by lawyers Mr. R.N. Poonai and Mr. S. J. Poonai, is contending that by an Order of the Caribbean Court of Justice, the  plaintiffs, Toolsie Persaud Limited, became the owners of  the Turkeyen properties.
The plaintiffs are alleging that the defendants in two separate cases, are unlawfully occupying portion of Area “F” Turkeyen, East Coast, Demerara, and have refused to vacate same despite notices to the effect.
According to the Plaintiffs in their Statement of Claim, “Areas “F”, “G” and “H” being portions of Turkeyen situate on the east sea coast of the County of Demerara,  in the Republic of Guyana,  the said areas  “F”, “G” and “H” containing areas  of  6.00,1, 4.675 and 4. 758 acres respectively, and being defined on a plan  by  I. Sheer Mohamed,  Sworn Land Surveyor, dated 30th October 1966, and being redefined on a plan by K. N. Maraj,  Sworn Land Surveyor dated 3td day of June, 1977 and recorded in the Department of Lands; and Surveys  on the 22nd day of January, 1993 as plan No. 17592 , no building thereon and together with and subject to all the following casements, rights, benefits, stipulations, restrictions, servitudes and obligations with intent that the same shall run with and be binding upon Plantation Turkeyen, cum annexis (herein after referred to as the Estate”) and the property  into whosoever hand the  same may come”.
The defendants are persons of age, unlawfully occupying a portion of the plaintiff’s land, more particularly a portion of Area “F”, Turkeyen , East Coast, Demerara .
The matter is expected to engage the attention of the court on Monday, October, 25, 2010.
