Must pay $125M to court before shipment could begin
JUSTICE Rishi Persaud granted the injunctive Order yesterday in favour of Essequibo farmer Arnold Sankar who supplied the Company (M. R. L.) with rice and was paid with five Demerara Bank Limited dishonoured cheques, that intended to cover payments totaling $125, 000, 000.
The plaintiff, who is a businessman and had borrowed money to pay farmers for their paddy, had not been paid by the defendant and had expended all his money from the bank.
The injunctive Order directed that the Respondent/Defendant, whether by themselves, their servants and or agents, be restrained and an interim injunction is hereby granted restraining them from removing , alienating or loading on board on any ship or vessel or in any manner whatsoever and howsoever from disposing of a quantity of rice of approximately five thousand tons, currently stored at Muneshwar’s Wharf, Water street, Georgetown, until further ordered or alternatively, unless and until the Respondent/Defendant lodges into this Honourable Court the sum of $125, 000, 000, along with costs and interest and until after the hearing and determination of a Summons in this cause returnable for the 11th day of August, 2010, at 10:00 a.m.
