INTERDICTED Police Constable Dellon Ellexy has moved to the

High Court, seeking a declaration that his right to a fair hearing within a reasonable time has been breached.

The constitutional motion he filed is related to a criminal charge laid against him, following a September 13, 2005 incident and he wants it permanently stayed or quashed.

Ellexy said the December 13, 2005, charge jointly accused him and Constable Quacy Allen of assaulting Fiaz Alli to cause him actual bodily harm.

Alli, based on allegation that he had threatened to shoot Ellexy, had also been charged with attempted murder and possession of an unlicensed firearm but the charges were dismissed by Magistrate Fazil Azeez.
