Willems/ Guyana Lumber granted Nisi Order against Guyana Forestry Commission

APPLICANTS Willems Timber and Trading Company Ltd and Guyana Lumber & Timber Co. Ltd have been granted a Nisi Order of Certiorari against Guyana Forestry Commission.

Upon reading the Notice of Motion on the part of the Applicants filed on September 17th, 2014, for Writs or Orders of Certiorari and Mandamus and the Affidavit of Cecil Persaud in his capacity as a Director of the Applicants company and upon hearing attorney-at-law for the Applicants:
Acting Chief Justice said: “It is hereby ordered that an Order or rule Nisi of Certiorari directed to the Guyana Forestry Commission, to show cause why its decision made and contained in a letter to the Applicant WTTCL dated the September 11th, 2014, to suspend the Applicant’s Timber Sales Agreement (TSA) No. 10/85 and TSA No. 01/91 should not be brought up to this Honourable Court and quashed on the ground that the said decision of the Guyana Forestry Commission is unlawful, unreasonable, arbitrary, capricious, irrational, procedurally improper, unconstitutional, ultra vires, null, void and of no legal effect.
“Secondly, an order or rule Nisi of Mandamus directed to the Guyana Forestry Commission to show cause why the suspension of WTTCL’s TSA No. 1085 and No. 01 should not be uplifted forthwith on the ground that the said decision of the Guyana Forestry Commission to suspend the Applicant’s Timber Sales Agreement is unlawful, unreasonable, arbitrary, capricious, irrational, procedurally improper, unconstitutional, ultra vires, null void and of no legal effect.
“And it is further ordered that a sealed and certified copy of the Notice of Motion, together with a sealed and certified copy of the Order Nisi be served on the Commissioner of Forests.
“And it is further Ordered that this matter do stand adjourned to Wednesday September 30th, 2014 at 1.30 pm. before the Honourable Chief Justice, Mr. Ian Chang.
