A West Coast Berbice father and son, are facing retrial for the murder of fellow villager Davanand Ramlagan, following a misunderstanding at Number 41 Village ,West Coast Berbice, on October 19,2002.Roy Pestano Snr. along with his son, Raymond, are jointly indicted with the unlawful killing, but pleaded not guilty during their arraignment at the Berbice Assizes on Monday.
When the initial case concluded on September 13, 2013, the jury were unable to arrive at a verdict..
The then forewoman, questioned by Justice Navindra Singh, who coincidently is presiding over the current trial, reported, that with respect to the Number One accused Raymond Pestano, 10 members were in favour of the prosecution’s case, while two had indicated that the accused was not guilty .
However, with respect to the elder Pestano, nine jurors pointed out that the 60 year old was guilty, while three members had disagreed
In her opening address to the mixed jury , Prosecutrix Ms. Reena Singh said, on October 19, 2002 at 9:30pm, Kenrick Ramlagan and Goel Richard Ross, were seated at Breezy Point shop at Number 41 Village, West Coast Berbice , when a car pulled up with the two accused men and another person. Certain events unfolded, resulting in Ross running in the direction of his home, where he saw his cousin Davanand Ramlagan in a pool of blood.
Government Pathologist Dr Nehaul Singh, revealed that there were four stab wounds, on the body of the 25-year- old man. Following investigations, the men were charged with the capital offence.
Meanwhile, Crime scene investigator Dharmendra Indrapaul, recalled taking pictures of the crime scene, but was unable to develop the film as no chemicals were available in the crime lab.
The matter has been adjourned to Monday 22 September, when the eye witnesses, Kenrick Ramlagan and Goel Richard Ross, are expected to testify.
