THE alleged Mocha murderers’ caution statements were yesterday ruled admissible in evidence and were read at the jury trial relating to the accused pair of Jevon Wharton and Charles Cush for the murder of Sade Stoby,nine.Judge Jo-Ann Barlow who had held a voir dire (a trial within a trial) to determine the admissibility of the statements, yesterday morning ruled that the caution statements given to the police by the accused were found to be admissible in evidence.
And she ruled that the caution statements be read to the jury.
Assistant Supt. of Police, Mr. Elston Baird, to whom the caution statement was given told about going to the scene of the crime.
According to Baird, Wharton told him in his statement after caution, “ I walk through the bushes on the dam with Sade. I had sex with her. After we finished she fell down and struck her head.”
The girl Sade who left her home at Barnwell North on November, 2007, was found murdered on the second day.
The police said that when found she was partly naked, her feet were apart and her head was swollen.
In relation to the number two accused, Cush, Detective Corporal Royston Blair who had taken a statement testified that Cush had admitted seeing Sade in company with another person who is not involved in the crime.
But reports state that the accused landed into trouble by the bruises on his penis which he could not account for.
Defence counsel Maxwell Mc Kay and D. Kissoon are accusing the prosecution of introducing an unfair report against the defence. The report has been denied.
The hearing is continuing.
