Linden murder trial continuing… Jury heard that Station Diary with proof of oral confession disappeared

JUSTIN Felix, called Justin Percival, is indicted for the murder of Paul Austin, called ‘Coolie’, on July 13th 2008, at Kara Kara, Linden.State Counsel Mrs. Teshana Lake and Miss Orinthia Schmitz are prosecuting.

Mr. Glenn Hanoman, in association with attorney-at-law, Miss Tanicia Daniels, is defending.
The prosecution is alleging that it has a strong case against the accused but defence counsel, Mr. Hanoman is contending that the allegation about an oral confession against his client is based on a claim which cannot be sustained by the Station Diary or any legal record.
Both counsel for the defence are saying that the prosecution is not adhering to the Standing Orders and accused them of being unable to produce the Station Diary, which if the allegation about an oral confession was true, the Station Diary should be helpful with details.
In answer to cross-examination by Mr. Hanoman, ASP Julius Wright, the Head of the Investigating team agreed that the Station Diary should be securely kept since it would contain relevant information in a pending matter.
In answer to further questions, Mr. Wright said that he was aware that the law of Guyana states that a person arrested should not be kept in detention beyond 72 hours of his arrest without being brought to court or being released unless there was an extension order from the court.
Mr. Wright also said in answer to another question, that no gunpowder residue was found on the hand of the accused.
The hearing continues today.
