Industry businessman refused bail on three fraud charges

BUSINESSMAN Besham Ganpat was Monday refused bail by Chief Magistrate Priya Sewnarine-Beharry on charges of obtaining on a false instrument, uttering a forged cheque and conspiracy to commit a felony. 

The defendant of Lot 15 First Street, Industry, East Coast Demerara, pleaded not guilty to all three charges, one of which said on August 22 at Diamond Housing Scheme, East Bank Demerara, with intent to defraud he obtained from Dharam Chand a quantity of office stationery valued at $4,400,800.
The second charge alleged that on the same day at Eccles, also on the East Bank of Demerara, with intent to defraud he uttered to Chand, one Republic Bank cheque to the same amount.
The third allegation is that between August 10 and 22 last, at Georgetown, he conspired with person or persons unknown to commit a felony, that is to say, he forged one Republic Bank cheque No. 0895939 in the amount of $4,400,800, knowing same to be false.
He was represented by attorney-at-law Mr. Leslie Sobers who requested bail in a reasonable sum, stating that his client is not a flight risk. He added that his client has substantial investment in this country and wants to come to court to defend himself.
Sobers revealed that his client is a businessman for over eight years and operates under the name of Global Stars International. He said his client has a matter in the High Court where he is suing an associate. He explained that on the day in question, his client was on his way to conduct business with one of his clients when the police made contact with him.
However, Police Prosecutor Michael Grant opposed bail on the grounds of the nature and gravity of the offence and the fact that the defendant was arrested on a sting operation and gave the police contradicting addresses.
Grant said the defendant was arrested on a sting operation and may pose a flight risk since investigations are ongoing and there are likely to be other charges to be instituted against him. The case will be called again on October 1.
