Both GuySuco, GAWU voluntarily accepted recommendation of Chief Justice

WE wish to refer to the article in the Kaieteur News headlined ‘Court orders arbitration again for sacked Skeldon Estate worker’ (18th March, 2015) which misrepresents the decision of the Honourable Chief Justice given on 17th March, 2015, with regard to the matter of the dismissal of Mr. Daniel Stephens.When the matter came before the Honourable Chief Justice, the injunctions sought by GAWU seeking that the task of the arbitrator in the matter was to enquire into the suspension, not the dismissal, of Mr. Stephens, were not granted by the Court.

The Honourable Chief Justice, in the circumstances, therefore, recommended that GuySuco and GAWU return to arbitration to determine the issue regarding the dismissal and not, as GAWU had argued, the suspension of Mr. Stephens.

Both GUYSUCO and GAWU voluntarily accepted the recommendation of the Chief Justice.

On the matter of the selection of the arbitrator, the Court made no intervention.
