Buggery accused granted $1M bail on appeal

BUSINESSMAN Kevin Jordan, 56, who was sentenced to jail after a Demerara Assizes jury found him guilty on a majority verdict after 70 minutes’ deliberation, is on $1M bail. On appeal out of time, lawyers for Jordan, Mr. Rex Mc Kay, S.C. and Mr. Neil Boston, successfully argued before Justice of Appeal B. S. Roy, that the majority verdict before two hours of deliberation should not have been accepted by Presiding Justice Dawn Gregory, since it was in breach of Sections 158 (b) of the Criminal Law (procedure) Act, Chapter 10:01.
Counsel are contending that as such, the conviction of Kevin Jordan was a nullity.
The prosecution arguing the case for the DPP could not have satisfied the court that the jury departed from the minimum of two hours before they delivered the majority verdict.
It was pointed out that only in exceptional circumstances, when an appellant is likely to succeed with his appeal, that such appellant is likely to be granted bail, pending the hearing of his appeal.
On the 11th day of December 2015, Justice Roy, sitting as a single judge in chambers granted the Petitioner leave to appeal out of time.

hambers.
Defence lawyers submitted to the court that the verdict of the jury was unlawful and the trial judge should have rejected it.
